Acupuncture consultations: a comprehensive intake via health questionnaire is followed by Traditional Chinese Medicine (TCM) diagnostic using the intake and possibly palpation of the wrists for pulse diagnosis; abdomen and limbs, back, buttocks and neck, the patient is clothed and/or covered; tongue diagnosis; observing color and odor; signs and symptoms. Observations are recorded and assist me in forming a differential diagnosis according to TCM syndromes. A treatment protocol is formed accordingly, taking into account current signs and symptoms. Different treatment methods are employed in a given consultation/treatment as per indications including acupuncture, moxibustion, cupping; gua sha; massage etc. Acupuncture practice uses sterile needles that are lightly tapped into acupuncture points, these are generally painless, though, some sensation may be experienced varying from tingling, pins and needle like, cool, warm, hot, pulsating, occasionally 'de qi' which can be likened to an electric wave. Needles are left in place from 20-60 minutes depending on the treatment approach.

Moxibustion may be applied in various forms: herbal burning stick gently warming the needles; cones of moxa on top of the needles for a more intense and deep heat; rice like cone moxa or dispersing pain etc. Heat from moxa varies from gentle to a more intense heat, though, is generally perceived as pleasant. Burns and/or scarring and/or blistering are a potential risk of moxibustion therapy.

Cupping uses glass cups that may be applied to areas of muscular tension; areas of ongoing pain due to stagnant blood; these may be left in place for 10-20 minutes or used as 'running cups' where the cups are glided along meridians and areas of muscular tension. Burns and/or scarring and/or blistering are a potential risk of cupping therapy.

Acupuncture consultations/treatments are customised depending on the individual presentation and typically one or more of the above methods of treatment are used. Treatments range from 30-90 minutes per session, this is established on a case-by-case basis.

Naturopathic consultations focus on a presenting “main condition/complaint” and include a comprehensive intake of current health condition; health history; family health history; medication and supplement use (past & current); recreational drug and alcohol use; body systems analysis; daily diet and lifestyle.  Upon which a treatment plan is made, providing a suggested course of treatment for the individual. This may be working integratively with other health professionals. I make no claim about curing any condition. I take all possible measures to keep personal information confidential. At times, it may be necessary for me to contact another of your health care providers in order to coordinate medical treatment, to discuss an emergency situation and /or to share appropriate medical information.

Your overall health and wellbeing are the focus of my practice.

TELE-HEALTH Naturopathic consultations: may be arranged by booking an appointment with me directly via text mobile or email as per my contact details above, in so doing you having agreed to this Client Service Agreement.

Naturopathic consultations, face-to-face or via TELE-HEALTH may be followed up with an email, summarising a personal treatment plan, including recommended supplements and how/where to obtain same. This is usually on-line via: Metagenics; vital.ly; Oborne Health Supplies; or Integria Healthcare, where I prescribe for you Practitioner Only Products, that I believe are of superior quality due to the quality assurance guaranteed by Practitioner Only companies within Australia. On-line consultations are held via Skype or in my Zoom meeting room on-line, this is arranged upon booking. Zoom provides a secure and private platform for such private consultations.

It is my responsibility as a health professional to maintain the relevant qualifications to practice.

As a practitioner who is a member of the above registered associations, I have had my qualifications assessed as meeting association requirements, and am subject to that associations Code of Conduct. As part of keeping my professional registrations current i hold a current first aid certificate; I am an accredited and financial member of ATMS and AHPRA and accredited member of CMBA; I hold relevant professional indemnity insurance.

Your Responsibilities

In order to care for your own safety I advise the following precautions/responsibilities: Provide me with your comprehensive and personal health history (this is typically done in an initial consultation or via my on-line intake form), updates must be communicated in consequent sessions/consultations; including details of the onset of your current condition; medication and supplements, also un-prescribed drugs and medication currently being taken, or historical abuse of same; and any substantial medication history; comply with the treatment plan, this may include dietary guidelines, lifestyle changes such as regular exercise and eliminating the use of recreational substances such as alcohol, smoking tobacco, and the use of un-prescribed drugs where advised; to comply with my recommendations and take herbs, vitamins and other therapeutic products prescribed by me as directed.

[ADVERSE EFFECTS]

In the case, where you may experience any adverse effects or have any concerns with consuming the prescribed supplements or adopting the recommended lifestyle changes, it is your responsibility to communicate this with me directly, this may be during your next appointment or in the form of an email or phone call as per my contact details in between times. I will respond as soon as is practical and in a timely manner.

Any un-toward reactions or adverse effects to prescribed products or lifestyle changes should be communicated to me first of all and I will endeavor to alleviate any concerns.

In the case of an emergency, such as an allergic or severe reaction to supplements, please go immediately to an Emergency Department nearest to you. Advise me of same as soon as is appropriate.

Problems & Potential Problems

ACUPUNCTURE is generally a safe practice, however, following an acupuncture treatment you may experience a feeling of complete relaxation, tiredness, faintness and light headedness, these will usually subside within two hours of the treatment, it is therefore ideal to rest for a couple of hours after a treatment and not engage in strenuous or demanding activities. It is not unusual to feel some minor discomfort or soreness after a treatment, typically before a marked improvement, this should last no longer than 24 hours. Physically, bruising, numbness, itching or tingling near the site of needle insertion may be felt. These are generally short-lived, but may last a few days, particularly in relation to bruising.

MOXIBUSTION and CUPPING incur a risk of burning, scarring, and discoloration of the skin, such as redness or bruising. In the case of redness or burning, running cold water over the area should alleviate any discomfort, contact me directly if blistering occurs. Infection is another possible risk, however, i use sterile disposable needles and strictly maintain a clean and safe environment in my acupuncture practice.

Of very low risk, acupuncture may cause premature labor as some points are contraindicated during pregnancy; nerve damage and organ puncture, including lung puncture (pneumothorax). As a competent practitioner of acupuncture, these should be of no concern to my clients.

[SPECIFIC INSTRUCTIONS FOR USING MY SERVICES]

The FOLLOWING will not necessarily exclude you from acupuncture treatments or using prescribed therapeutics, however, it is vitaly important that you advise me of same:

Do not have acupuncture if you are under the influence of alcohol or have misused drugs.

Advise me if you are taking any blood thinning medications or have any blood or bleeding disorders.

Advise me if you have a pace-maker, botox or other implants.

[OTHER CONSIDERATIONS]

In most cases when choosing acupuncture as a health method, a course of treatment may be needed. This is advised on a case-by case basis. In the case of using multiple therapies as part of your healing process, it is advisable to receive acupuncture on a different day to other practices. I can advise you more particularly on this on a case-by-case basis.

[DISTINGUISHING AN ACUPUNCTURE CONSULTATION FROM A NATUROPATHIC CONSULTATION]

Acupuncture consultation & treatments may include the prescription of therapeutic herbal & nutrient formulas, dietary and lifestyle (exercise, sedentary behaviours etc.) advice.

Naturopathic consultations do not include acupuncture, but may include the prescribing of naturopathic therapeutic formulas that may include nutrients, herbs and whole foods; dietary and lifestyle advice.

[WORKING IN CONJUNCTION WITH OTHER HEALTH PROFESSIONALS]

It is your responsibility to inform me that you are engaging with other health practices.

At times, I may recommend that you seek further professional support, for example, pathology tests, and/or the services of other health professionals working in specialised fields i.e, psychiatry; dentistry etc. as per indications. This is advised on a case-by-case basis.

[RESULTS]

Acupuncture treatments aim to treat the whole person and therefore acupuncture can’t always be absolutely precise in its effects.

Results also vary in the practice of acupuncture and naturopathy as are determined from the degree of imbalance and disharmony you present with. The course of treatment is very individual and may vary from one treatment to a course of treatment. Compliance is essential as is feedback from you, the client, from one treatment to the next, this helps to shape the course of treatment.

Intellectual Property

I specially reserve all of my Sites intellectual property rights and its contents, including, but not limited to, copyright in material and or services provided by me. The material on the website is proved for personal use only and may not be re-sold and/or re-distributed in any material form, stored in any storage media, or re-transmitted in any media without prior written consent from me.

Payment Terms

 [FORMS OF PAYMENT]

All invoices are issued at the time of your scheduled appointment and payment is due directly (on the day of service) via Direct Deposit as per transfer details provided on the invoice. Receipts are issued immediately upon receiving payment by email or on paper upon request.

[HEALTH REBATES]

In accordance with your private health insurance policy on acupuncture services, you may be entitled to a rebate. Please use the receipt of payment to make these claims directly via your health insurer.

Note, at this time no health rebates are available on naturopathic consultations nor for on-line, tele-health naturopathic consultations. There is currently no rebate on products.

[NO SHOW]

In the case of a ‘no-show’, meaning you didn’t attend your scheduled appointment, nor did you communicate your inability to attend you will be invoiced the full fee.

[LATE SHOW]

As I need to stick to schedule to meet other appointments, please advise me if you are running more than 15 minutes late as we may need to reschedule your appointment in which case a $50 cancellation fee will apply.

[CANCELLATIONS]

With more than 24 hours-notice, no fee is applied.

Cancellations within 24 hours incur a $50 cancellation fee. Invoice will be sent via the email address provided; this will not be covered by private health insurance; payment is due immediately upon invoicing as per scheduled appointments.

[ON-LINE NATUROPATHIC CONSULTATIONS]

Tele health or on-line Naturopathic Consultation clients will receive my naturopathic recommendations and patient order details via email within 48 hours of me receiving your Direct Deposit for the consultation.

[PAYMENT PLANS]

From time to time, we are all met with special circumstances, should you be experiencing financial stress I may arrange a payment plan that works for us both. Payment plans are arranged upon request only and on a case-by-case scenario prior to any consultation.

[CURRENCY & GST]

All fees are charged in Australian Dollars. I am not registered for GST my health services are exempt.

Shipping and Delivery

 [SHIPPING]

In a face-to face situation, as per consultation or treatment, I do my best to offer product immediately, in which case payment is expected immediately via direct transfer and receipts are issued via email upon me noting the transfer into my bank account. This is typically within 7 days of the transaction. In the case where I don’t have the appropriate product on hand, I will order at my soonest convenience in which case the product is delivered to me within a couple of days or a patient order scenario is created where you place the order and have the product delivered to your preferred address.

[DELIVERY OF SERVICES]

Face–to-face appointments for acupuncture and/or naturopathic consultations are currently all held at: 18 Home Road, Nar Nar Goon. 3812.

On-line Naturopathic Consultations will be held on Skype or preferably ZOOM (see below for more details on how this functions).

From my website at joriley.com use the Book Online button that will link you to Halaxy, my booking platform. When you make a booking via this route, you will receive a Patient Intake Form via the email address you provided. For privacy and security reasons, patient intake forms are emailed using a secure link contained within the email template. You can click or copy the link into your browser to access the intake form. The link expires one week after being sent, so you must complete the form within that time.

The Patient Intake Form requests:

  • Personal Details: name; address; date of birth; and email address.

  • Clinical Questionnaire for you to detail your current health issues and your medical health history; family health history; current medication and supplement profiles.

  • Records your Consent to Treatment and Terms of Service.

TELE-HEALTH naturopathic consultations are held on-line, preferably via Zoom or Skype to secure your privacy. You may opt for a telephone consultation.

Zoom: (First time user on ZOOM:- You will  need to install the platform, this is very straight forward and you can do this immediately, you don’t need to wait for our meeting. Simply Google, ‘Zoom.us download’. You should only need to take this step once).

Once you have booked your On-Line-Naturopathic Consultation, you will be prompted to complete a Patient Intake Form as above, once the documents are completed, a meeting is created in ZOOM and you will receive a ZOOM invitation via email to meet me in my ZOOM meeting room. You will be notified with the details via the email address that you provided upon booking. PLEASE NOTE: I will manually create the ZOOM meeting appointment and will attend to this as soon as possible, typically within 24 hours.

Skype: Once you have created your on-line booking time and completed the Patient Intake Form and ‘Consent and Service Agreement Form’, you will need to email me this preference with your Skype name as soon as possible after your booking is confirmed via Halaxy, so we are all ready to go at the scheduled time My Skype name is: joriley63. Alternatively, I will contact you to obtain your Skype name.

[MISSED SESSIONS]

In the case where you don’t attend your scheduled appointment you will incur a no-show fee as noted in the PAYMENT TERMS.

Returns Policy

If you are purchasing products from me, please read the following carefully to ensure you are fully aware of your rights under this policy and my obligations to you.

I do not offer a "change of mind" refund for items from the following categories under any circumstances:

  • Medicines (Prescribed or Over the Counter)

  • Vitamin Supplements

  • Herbal supplements

  • Consumable Products

Under Australian Consumer Law, I will provide you with an exchange or refund where the product is: 

  • ‘out of date’ as of the day of purchase

  • significantly different to what was shown or described to you

  • if the product is not of acceptable quality at the time of purchasing

Refunds will be issued using your original payment method

 I reserve the right not to offer an exchange or refund where the item fault is a result of misuse or neglect.

For returns under Australian Consumer Law, please contact me to arrange a resolution. This may include returning the product to me by post or collection of the item for assessment, exchange, repair or refund. These arrangements are made on a case by case basis.

Even though great care is taken in the shipping process, if your item/s arrives damaged, please contact me to assess the damage and to work out a solution. You may be requested to provide a photograph of your item/s and /or delivery package to aid a speedy resolution.

If you have any issues with online orders where I am not the supplier, please contact the supplier directly. Should an appropriate arrangement not be made then contact me on jorileywellness@gmail.com  so I can assist you with following up on the issue.

Ideally to be used within six months of the purchase date; they may be used for services only; they may not be returned, refunded or exchanged for cash.

Consumer Guarantees

It is possible that our consultation may be disrupted by unforeseen circumstances, for example, power outage; internet cutting out or distorting communications or any other such event that is out of our control. If this happens, your appointment will be rescheduled at the soonest convenience and at the outside 7 days from the original appointment. If this time frame is not suitable for either party, a full refund will be applied.

[ACUPUNCTURE & NATUROPATHIC SERVICES]

I make no claim to cure any disease or terminal illness. While I may claim the capacity to aid your recovery of conditions associated with some diseases and terminal illness, I make no guarantees as the results you achieve are based on a wide range of factors beyond my control. My claims are based on the established role of acupuncture & naturopathy in alleviating signs and symptoms associated with many health conditions. The only thing I guarantee is that I will provide my services with due care and skill.

I reserve the right to delete comments on my blog that I consider to be inappropriate. Offensive and/or abusive language, racist remarks, spam, naming, shaming or bullying will not be tolerated and comments removed immediately without notice.

Jurisdiction & Dispute Resolution

If any concerns or issues arise out of these Terms & Conditions of use of my website, we both agree to communicate with the intention of making a genuine effort to seek a win/win solution and resolve any dispute by negotiation and discussion.

[NEGOTIATION]

If we are unable to resolve a dispute by negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an independent accredited mediator, seeking online dispute resolution or mediation by telephone if we are not both in Victoria, Australia.

The mediator is to be appointed by agreement between us or, failing agreement within twenty-one (21) days of the first notification of the dispute, the person initiating the dispute will seek the appointment of a dispute resolution professional by the Resolution Institute: https://www.resolution.institute/resolving-disputes/get-a-professional. The Resolution Institute Mediation Rules shall apply to the mediation and we agree to share the costs of mediation equally between us.

[MEDIATION]

We agree that neither of us will commence legal action until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.

We both agree that we shall not publicly or privately disparage each other or anyone connected with the other’s business, but rather shall act in good faith to refrain from any conduct or communication which might reasonably be expected to interfere with the business and/or personal interests of each other.

[LITIGATION]

Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of Victoria, and the Commonwealth of Australia, will have exclusive jurisdiction.
